You may use the forms on this page if the following factors apply to your situation :
- You want to have the court appoint a guardian for a minor or revoke a pre-existing guardianship and appoint a new guardian for a minor, and you know that you do not need the court to appoint a conservator for the minor, AND
- The minor lives in Maricopa County, AND
- Notice is provided to parents...
- After giving notice of the petition for guardianship to BOTH parents (if living), one or both parents will give permission by signing a voluntary consent, and/or neither parent will oppose the guardianship*,
- Unless the minor is 16 or older and you can show that no parent is willing or able to exercise the powers and duties of a guardian.
Please note:
If you are not related by blood to the minor, you must get your fingerprints taken (if you haven't already) for submission to Arizona Department of Public Safety and the FBI for a criminal background check.
You may use also this packet if you are requesting a temporary guardianship (6 months or less).
*If either parent files papers opposing a guardianship, it will not be granted. An attorney may be able to advise whether another action such as for “Juvenile Dependency” or non-parent custody may be appropriate.
